الاجتهاد والتقليد
Independent Reasoning and Following
This compact chapter covers the fourth pole, the one who derives rulings, and the last station of the inference pipeline, where a ruling is weighed by the competence of whoever states it. It defines ijtihad as the jurist's full exertion to reach a probable judgement where no definitive proof exists, gives its legal status and al-Ghazali's conditions, with al-Shatibi's priority of understanding the objectives, and treats partial ijtihad. It sets out the ranks of jurists in the general scheme of Ibn al-Salah and in each school, the question whether an age may lack a mujtahid, the dispute over whether every mujtahid is right, and the rule that one ijtihad does not annul another. It then defines taqlid with Ibn al-Humam, its status in creed and practice, following the less learned, following the dead, committing to one school, changing schools, chasing concessions and combining schools, and ends with a table on how the relied-upon position is identified in each school.
